When used in this User Agreement, the term "Forum" includes the various forums and discussions boards located at the url: www.nhbgear.com/forum.

The terms "Jiu Jitsu Gear" and "NHB Gear" include the websites located at the url: www.jiujitsugear.com, www.nhbgear.com, www.jjgear.com, the Forum, NHB Gear, LLC, its members and managers, and all administrators and moderators of the Forum.

You agree, through your registration at the Forum, not to post or link to copyrighted material unless the owners of said material have released it into the public domain. This may include links to instructional videos, television or Pay-Per-View broadcasts, sporting events, e-books, music files, or other material. Sites such as YouTube, Rapidshare, and MegaUpload are often hosts of such material, so take care when posting links to files there.

Posts, topics, links, personal messages, or any other communication using this forum's resources may not contain pornography, nudity, or any other content which is deemed obscene, lewd, lascivious, indecent, filthy or vile material. This includes pictures, video, links to external websites, artwork, and/or text whether created by you or someone else. If there is a doubt whether such material is appropriate for the forum it is generally best not to post it.

Tape or DVD trading is forbidden on the Forum. You may not use the Forum's messaging systems (public or private) for this purpose. Making copies of instructionals, fighting events, or any other copyrighted material for distribution is illegal and you may not use the Forum in any way for this type of activity. Violators will be banned and NHB Gear will cooperate with copyright owners to enforce their legal rights.

Trolling and/or impersonating another person, celebrity, or member of the Forum is a bannable offense. Visit another forum for that.

You further agree that you will not post any material which is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, threatening, invasive of a person's privacy, or otherwise in violation of ANY law. These are considered serious offenses and appropriate measures will be taken in response to them including, but not limited to, banning you from using the Forum. You also agree not to post any copyrighted material unless the copyright is owned by you or you have consent from the owner of the copyrighted material. Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are also inappropriate on the Forum.

Note that it is impossible for us to confirm the validity of posts on the Forum. Please remember that we do not actively monitor the posted messages and are not responsible for their content which may include, but not be limited to, pictures, links to other forums, information, downloads of programs and/or audio-visual data. We do not warrant the accuracy, completeness or usefulness of any information presented and you agree that you assume the risk and sole responsibility for anything that you download from the Forum including, but not limited to, any message, data, or program (which may include malicious viruses or other harmful programs). Additionally, you agree that NHB Gear is not liable to you in any way for anything that is posted on the Forum, including, but not limited to, any errors or omissions related to anything that is posted.

Anyone who feels that a posted message is objectionable is encouraged to notify an administrator(s) of the Forum immediately. After a review, NHB Gear has the right to remove, edit, alter, or delete any post for ANY reason OR leave the posts in their original form. The decision to do so rests within the sole discretion of NHB Gear. Remember, post removal is a manual process, so please realize that it may not be possible to remove or edit particular messages immediately. Note that NHB Gear is not required to take action to remove posts merely because there is a complaint lodged. This policy goes for member profile information as well. All posts, threads, information, hosted files, and other data that reside on the NHB Gear servers become the sole property of NHB Gear.

You remain solely responsible for the content of your messages, and you agree to indemnify and hold harmless, NHB Gear, and any other websites related to the Forum. NHB Gear also reserves the right to reveal your identity (or any information we have about you) in the event of a complaint or legal action arising from any information posted by you.

You have the ability, as you register, to choose your username. NHB Gear advises that you keep the name appropriate. With this user account you are about to register, you agree to never give your password out to another member, for your protection and for validity reasons. You also agree to NEVER use another member's account to post messages or browse the Forum. Multiple usernames or aliases are discouraged and will be deleted.

After you register and log into the Forum, you can fill out a detailed profile. It is your responsibility to present clean and accurate information. Any information NHB Gear deems inaccurate or vulgar will be removed.

Please note that, with each post, your IP address is recorded in the event that you need to be banned or your ISP contacted. This generally only occurs in the event of a major violation of this agreement, but NHB Gear reserves the right to deny access for any reason.

The waiver by NHB Gear of any breach of any provision of this Agreement by you or any other member of the Forum shall not operate as, or be construed as, a waiver of any subsequent breach. No waiver of any of the provisions of this Agreement shall be valid unless the same is in writing and is signed by the party against which it is sought to be enforced.

This User Agreement contains the entire understanding between you and NHB Gear, and supercedes any and all prior agreements, statements or understandings pertaining to this subject matter. NHB Gear may amend this User Agreement from time to time and you agree to be bound by and subject to any such amended agreement. The Amended Agreement shall be posted on the Forum registration page currently located at url: http://www.nhbgear.com/forum/index.php?action=register - and shall become effective immediately upon its posting at said url.

The validity, interpretation, and enforcement of this Agreement shall be construed in accordance with the laws of the Commonwealth of Virginia regardless of its conflict of laws rules. Venue for any litigation concerning this Agreement and all matters related thereto shall be exclusively in the Circuit Court for Fairfax County, Virginia.

If any portion of this Agreement is held to be invalid or unenforceable by any court of competent jurisdiction, it shall not affect the enforceability of any other portion of this Agreement.

If it becomes necessary for NHB Gear to retain legal counsel to enforce this User Agreement, NHB Gear shall be entitled to recover, in addition to any other damages recoverable, all of its reasonable attorney fees, court costs, and litigation expenses, if any, including, but not limited to, expert witness fees and court reporter fees, incurred in enforcing this Agreement and in obtaining, enforcing and/or defending any judgment related thereto.
